Commercial use, distribution, broadcast, or other use of any work or portion of any work on this website is not permitted without prior written consent from an authorized representative of Colby-Sawyer College.  Authorization by Colby-Sawyer College is not a copyright agreement and it does not remove the researcher’s responsibility to receive permission for copyright held by others.  In addition, the Cleveland Colby Colgate Archives does not surrender its own right to publish the items nor the right to grant this permission to others. The Cleveland, Colby, Colgate Archives holds copyright to selected works featured on Haystack for which those rights were granted by the donor in accordance with U.S. and international copyright laws. Copyright to some materials, however, may belong to the creators or their descendants or may be in the public domain. Commercial use or distribution of any work on Haystack is not permitted without prior permission of the copyright owner.

Whenever possible, the Cleveland Colby Colgate Archives provides copyright information on its item records and finding aids.  The Cleveland Colby Colgate Archives claims no rights beyond ownership of the materials unless such rights have been explicitly transferred by the donor.  It is the researcher’s obligation to determine and satisfy copyright or other use restrictions before making commercial, broadcast, or other use of the material.

Under United States copyright law, libraries and archives are authorized to create a photocopy or other reproduction that is not to be “used for any purpose other than private study, scholarship, or research.” If a user transmits or duplicates a reproduction for purposes other than “fair use” and does not receive written permission from the copyright owner that researcher may be subject to copyright infringement.
